Nvidia H200 AI chips have been arriving at ByteDance and Tencent in recent weeks — each received about 10,000 units. The Trump administration approved H200 sales to China in December 2025, with the Commerce Department establishing a case-by-case license review process in January 2026. About ten Chinese firms got clearance to buy H200 chips, including Alibaba, JD.com, ByteDance, and Tencent — up to 75,000 units each under the initial terms. The H200 is Nvidia's second-most-powerful chip; newer Blackwell and Rubin processors remain off-limits to Chinese buyers. Bipartisan bills in both chambers — the AI OVERWATCH Act — would ban Blackwell-class exports and give Congress veto power over future chip sales to adversaries. Neither has had a full floor vote.
1. Congress Says the PLA Is Already Using These Chips (Rep. John Moolenaar, Sen. Elizabeth Warren, Rep. Raja Krishnamoorthi)
Nvidia hardware ended up in China's military before anyone drew this line — and the same path is open now.
Nvidia's chips are already running inside China's military — via DeepSeek. Internal documents produced to the House Select Committee on the Chinese Communist Party show that Nvidia engineers gave DeepSeek technical support. Rep. John Moolenaar (R-MI), the committee's chair, and Rep. Raja Krishnamoorthi (D-IL) said DeepSeek's AI models are now integrated into People's Liberation Army (PLA) systems.
The security certification required for sales is mostly unenforceable. The BIS rule requires Chinese buyers to certify that the chips won't serve military purposes. Sen. Elizabeth Warren (D-MA) and Rep. Gregory Meeks (D-NY) demanded Commerce disclose how it's verifying compliance in December 2025 — invoking a congressional power under statute to force the disclosure. Critics say the PLA-DeepSeek connection proves the certifications don't work.
Congress is moving to block the next generation of sales. The AI OVERWATCH Act passed the House Foreign Affairs Committee 42–2 in January 2026, sponsored by Rep. Brian Mast (R-FL). The Senate version, co-sponsored by Warren and Sen. Jim Banks (R-IN), would ban Blackwell-class chips from China for two years and require congressional review of any future export license — the same oversight structure used for weapons.
2. But Commerce Says the H200 Is Yesterday's Tech (Trump Administration)
The newest, most dangerous chips are still blocked — and the deal brings money back to the U.S.
The H200 isn't the chip that determines the AI race. Blackwell and Rubin — Nvidia's current and next-generation processors — remain restricted. What ByteDance and Tencent received in recent weeks is the prior generation, which Nvidia's CEO has publicly called old news in the context of frontier AI.
The approval puts money back in U.S. hands. Trump structured the deal with a 25% revenue share flowing to the U.S. government. The Bureau of Industry and Security's case-by-case review requires buyers to obtain security certifications under rule 2026-00789. The administration's argument: total denial just redirects Chinese spending to Huawei.
China is also trying to slow the imports down. Beijing has capped total H200 imports below 200,000 chips — less than half what the approved firms requested. It's trying to protect Huawei and domestic chipmakers, not absorb American chips. That makes the national security case against the deal harder to state simply.
3. Nvidia Says the Bans Already Made Things Worse (Jensen Huang, CEO of Nvidia)
The years of tight controls handed Huawei the market — H200 sales are trying to claw back something.
The export bans already handed Huawei China's AI chip market. Nvidia CEO Jensen Huang has said the prior controls "largely backfired" by accelerating China's push for chip independence. Huawei's AI chip revenue is projected at $12 billion this year — up 60% year-over-year — filling the gap the export rules created.
Nvidia's China market share is now zero. Huang disclosed in May 2026 that Nvidia has no presence in China's AI chip market. Brookings researcher Mark MacCarthy wrote in July that "the ball game is over" for U.S. chip companies in China. U.S. regulators wanted decoupling. China moved on. Now Washington is having second thoughts.
Blackwell and Rubin are still off-limits. They remain restricted under the January 2026 BIS rule. The H200 is the exception — monitored, case-by-case, below the frontier threshold. That's the line the administration drew.
Where This Lands
Security hawks led by Moolenaar, Warren, and a bipartisan coalition say the PLA-DeepSeek connection proves end-user certifications don't work, and they want Congress to take over chip export oversight before the next round of approvals. The Trump administration and Commerce say the H200 is old enough to be safe, and that total denial was always Huawei's best recruiting pitch. Nvidia's position is that the damage from earlier bans was already done, and partial access beats conceding the entire market. The AI OVERWATCH Act is the next pressure point. If it gets a floor vote, Congress will have to say whether chip export policy is a trade tool or a national security line — and those are different things to cross.
