On July 28, 2026, the Trump administration formally banned federal funding for "dangerous gain-of-function research" (DGOF) — experiments that enhance a pathogen's transmissibility, lethality, or ability to resist treatment. NIH Director Jay Bhattacharya and Undersecretary of State Tom DiNanno co-announced the policy; HHS Secretary Robert F. Kennedy Jr. issued a joint statement the same day. It implements an executive order Trump signed in May 2025 and replaces the Biden-era P3CO framework, which required expert review rather than prohibition. The ban is in effect now. Researchers must halt any work that may fall under the definition, notify their institutional officials, and attest in writing. Violations can result in a 5-year ban from federal life sciences funding.
1. This Research May Have Caused COVID — End It (NIH Director Jay Bhattacharya, HHS Secretary Robert F. Kennedy Jr.)
They've settled the COVID origin question: federally funded pathogen experiments are too dangerous to fund.
COVID may have come from a federally funded lab. Starting in 2014, NIH gave EcoHealth Alliance $3.7 million to study bat coronaviruses at the Wuhan Institute of Virology. The FBI and DHS have concluded a lab accident is the most likely origin of SARS-CoV-2. For Bhattacharya and Kennedy, that connection is the entire argument.
The previous oversight system failed. The old P3CO framework assigned expert panels to catch problems before anything escaped. The dangerous research kept going anyway. Bhattacharya argues that expert review isn't enough when the downside is a global pandemic: "This groundbreaking government-wide policy establishes, for the first time, an explicit prohibition on dangerous gain-of-function research which can significantly endanger American lives."
The new policy still allows vaccine research. Kennedy stated the risk-based model "still leaves room for research on vaccines and other medical tools" — the ban targets enhancement experiments specifically, not all infectious disease science. Former CDC Director Robert Redfield co-authored a July 29 op-ed supporting the policy. He cited declassified intelligence showing more than 120 biolabs in 30 countries had conducted gain-of-function research funded in part by U.S. taxpayers.
2. But Banning It Leaves Us Less Prepared (American Society for Microbiology, Kristin Matthews, Baker Institute)
They need these experiments to design the vaccines and treatments that stop the next pandemic.
We can't fight the next pandemic without this research. Kristin Matthews, a Baker Institute Fellow at Rice University, put it plainly: "If we ban it, the next time another COVID virus comes through we won't have the data to quickly find new treatments, screening and even preventative measures."
H5N1 bird flu research is on hold. This ban likely covers studies identifying the key H5N1 mutations that let avian flu spread between mammals — the research scientists need to design vaccines before a bird flu pandemic hits. Under the interim enforcement period that preceded this policy, NIH suspended roughly 40 experiments, including 11 tuberculosis studies.
The research moves to China, not nowhere. The American Society for Microbiology warned the policy "broadly defines several categories of research that, if shut down, will impede our ability as a nation to address infectious disease threats." ASM Chief Strategy Officer Allen Segal stated: "We should be investing in facilities and training to ensure that it is being done safely, rather than taking the risk of prohibiting research to detect, prevent, and treat illness." Critics warn that if U.S. labs stop this work, researchers in countries with weaker safety oversight will carry it on.
3. Most Scientists Wanted Stricter Oversight, Not This Ban (Marc Lipsitch, Harvard; ASM 2023 Scientific Consensus)
Most scientists support stronger oversight of gain-of-function work. They don't support this definition.
Most scientists actually support tighter rules. Harvard epidemiologist Marc Lipsitch has argued for years that gain-of-function research "risks are not worth the potential gains" and that lab results don't generalize well across closely related strains. The American Society for Microbiology itself called for enhanced oversight at a 2023 consensus workshop — before there was a Trump ban to oppose.
This definition is too broad. Lipsitch said the policy's error bars "range from too permissive to too restrictive" — meaning he may share the goal of tighter rules but objects to how the administration drew the line. In a concrete example, NIH suspended an antibody study that doesn't involve live pathogens at all — because the definition was broad enough to catch it.
Independent review is what the scientific consensus actually asked for. ASM's 2023 workshop recommended enhanced oversight with independent expert review, not an outright ban. The Trump policy creates an independent review body — but only for research the government first flags as potentially within the ban's scope. Research classified as outright DGOF is simply prohibited. Scientists in this camp argue that experts should review the classification decision before the ban kicks in, not after.
Where This Lands
The ban is in effect now. Bhattacharya and Kennedy say it eliminates a category of federally funded research they believe caused COVID. The pandemic preparedness community says the ban stops the experiments needed to design vaccines for the next outbreak — and warns the work will move to countries with weaker safety oversight, not disappear. The middle position — that enhanced independent review beats an outright ban — is what most scientific societies proposed before the Trump administration announced this policy.
