Missouri's Republican legislature drew the 2025 map, HB1, at President Trump's urging, to flip one of the state's eight U.S. House seats from Democrat to Republican. A citizen group gathered more than 305,000 signatures to force a referendum on it, and on Sept. 3 the Missouri Supreme Court blocked HB1 until voters decide, ordering election officials to use the old 2022 map instead. A federal judge then ordered the opposite, Secretary of State Denny Hoskins followed the federal order, and on Thursday the Missouri Supreme Court held a contempt hearing over it — the same day the U.S. Supreme Court stepped back in.

1. Hoskins Was Just Following Federal Law (State Sen. Rick Brattin and 13 Missouri Legislators)

They say punishing Hoskins for obeying a federal court order would be the real constitutional violation.

A federal judge ordered Hoskins to use the new map. U.S. District Judge Stephen Clark ordered Missouri to run the 2026 election on HB1, warning that switching maps this late would cause "widespread voter confusion." Hoskins directed local election clerks to follow that order.

Brattin calls the contempt threat unconstitutional. He said he signed onto a letter to the court because he was "deeply concerned that holding a statewide elected official in contempt for obeying a federal order would upset that constitutional balance and set a dangerous precedent."

Fourteen legislators told the court a federal order beats a state one. The letter to Chief Justice W. Brent Powell argued the U.S. Constitution's Supremacy Clause puts Judge Clark's order above the state Supreme Court's, and warned lawmakers would move to impeach "the responsible members of this Court" under Article VII of the Missouri Constitution if the court punished Hoskins for it.

Missouri's new map is one piece of a bigger national fight. HB1 sits inside a Trump-driven push across Republican-led states — Missouri, Texas, North Carolina, Ohio — to redraw districts mid-decade and protect the GOP's U.S. House majority before the midterms.

2. The Referendum Did Exactly Its Job (Richard von Glahn, People Not Politicians Missouri)

Von Glahn's group spent a year collecting signatures for this fight and says the courts just proved the process works.

More than 305,000 Missourians signed to force this map onto the ballot. People Not Politicians Missouri collected the signatures needed to put HB1 to a statewide referendum vote this November.

Hoskins tried to keep the question off the ballot. The Missouri Supreme Court unanimously rejected that, finding nothing in state law exempts redistricting maps from the referendum process.

Von Glahn calls HB1 a power grab, not ordinary politics. "Over 305,000 Missouri voters — Republicans, Democrats and Independents — took action to block this political power grab," he said. "People, not politicians, will have the final say when they vote NO on Proposition A this November."

He says other states are watching how this ends. Von Glahn has argued the fight reaches beyond Missouri, calling a referendum win a signal that "the people still hold the power" as mid-decade redistricting spreads to other states.

3. The Impeachment Threat Is the Real Story Here (Retired Chief Justice Michael Wolff and Law Professor Vikram David Amar)

This camp isn't defending or attacking Hoskins — it's warning that lawmakers tried to punish judges before they'd even ruled.

Fourteen lawmakers threatened impeachment before the court had decided anything. Their letter promised impeachment proceedings against "the responsible members" of the court if it held Hoskins in contempt — they sent it before the hearing even happened.

Wolff says the law should decide this, not Washington. The retired chief justice wrote that "despite the gamesmanship dictated from the District of Columbia, the winner will be the rule of law."

Law professor Vikram David Amar says Missouri's legal case was always weak. The UC Davis scholar has argued the Missouri Supreme Court's block of HB1 will likely survive any federal appeal, since the state constitution plainly allows a referendum on a law like HB1.

The contempt finding still landed, even without punishment. Chief Justice Powell ruled Hoskins had, in fact, been in contempt — he'd just "purged" it by switching back to the 2022 map that same Thursday, before the court imposed any sanction.

Where This Lands

For now, Missouri goes back to its 2022 map for November, after the U.S. Supreme Court blocked the federal order requiring HB1 and Hoskins reversed course rather than face contempt. Brattin and the 14 legislators see a court that was about to punish a state official for obeying federal law, and say they said so before the ruling to head that off. Von Glahn's campaign sees a referendum working exactly the way it's supposed to, with the map now waiting on Missouri voters instead of taking effect early. Wolff and Amar see a legislature that tried to pressure sitting judges before the judges had even ruled, regardless of who turns out to be right about Hoskins. The underlying appeal is still moving through the Eighth Circuit, and HB1 itself heads to Missouri voters as a referendum this November.
