Federal agents searched the Washington-area home of Rep. Ilhan Omar, a Minnesota Democrat, early Monday. The Justice Department said Homeland Security Investigations agents carried out a search warrant that a judge approved. It called the search part of "an ongoing federal criminal investigation" but didn't name Omar or give other details. Citing unnamed sources, Fox News, CBS and ABC reported that the probe concerns Omar's immigration paperwork. Fox's sources said her late father filled out that paperwork when she was a child. Republicans have accused Omar of immigration fraud for years. Some claim she married her brother. She has called those claims "disgusting lies." Omar's office hadn't commented on the search as of late Monday morning. She's up for reelection Nov. 3.
1. If It's Fraud, She Should Lose Her Citizenship (Mace, Loomer, Benny Johnson)
Conservatives seized on the search, and two called for her deportation.
Agents were presumably after the same records she tried to subpoena, Rep. Nancy Mace says. Mace, a South Carolina Republican, said she tried to subpoena Omar's immigration records. "Both parties blocked it in Oversight," she wrote on X. She said the agents came "presumably over the same paperwork." "If the fraud is proven, she should be denaturalized and deported home to Somalia," Mace wrote.
At least one activist is celebrating. "This is what I voted for! Deport her back to Somalia!" conservative activist Laura Loomer wrote on X. She said investigators are looking at Omar for marrying her brother. But Fox's sources pointed to paperwork from Omar's childhood. Conservative podcaster Benny Johnson said the search is about documents from when Omar came to the United States.
2. The Administration Says No One Is Above the Law (JD Vance, Mullin, Homan)
Homeland Security Secretary Markwayne Mullin says any case wouldn't be political. His department says no one is above the law.
Officials have said for months that they were looking at her. In March, Vice President JD Vance said without offering evidence that Omar "definitely committed immigration fraud." In May, he said that "something fishy is there" and that "if we think there's a crime, we're going to prosecute that crime." Mullin said at a Republican event on Sept. 10 that "something's going to happen."
Any case wouldn't be political, Mullin says. "If we actually move a case forward, it's not a political case," Mullin said. A DHS spokesman told JNS the next day that "no one, including members of Congress, are above the law."
The Justice Department doesn't think it broke its election policy, one source says. A person familiar with the search told CNBC the department doesn't think the search violates that policy, because it wasn't meant to be public.
Officials aren't saying more yet. On Monday, White House border czar Tom Homan told Fox News he'd leave the specifics to Justice and Homeland Security leaders. "I don't want to get ahead of them commenting on an ongoing investigation," he said.
3. But a Former Prosecutor Says the Timing Breaks Justice Department Practice (Joyce Vance)
A former federal prosecutor says the department usually avoids steps like this right before an election.
The department usually holds off before elections, a former prosecutor says. "We are within the period before an election where DOJ doesn't take overt steps in an investigation that might influence its outcome," former U.S. Attorney Joyce Vance wrote on X. "Another hard norm out the window," she added. NBC reported that the department's 60-day pause before elections is an unwritten practice. The written policy bars agents and prosecutors from timing investigative steps to influence an election.
Minnesotans are already voting. More than 127,000 people in Minnesota have already voted, CNN reported, citing the secretary of state.
4. And Omar's Side Has Called the Fraud Claims Lies for Years (Omar, Connor McNutt)
Omar hasn't commented on the search, but she and her office have long called the claims lies.
Her office has called the claims lies. In March, Omar's chief of staff Connor McNutt called JD Vance's fraud accusation "a ridiculous lie." "This is rich coming from someone who literally said they were willing to 'create stories' to redirect the media," McNutt said.
She has brushed off her accusers. Asked in December 2025 why Homan brought up the probe, Omar said, "Because they're sick." The Daily Beast reported that in September, she told Fox News investigators hadn't contacted her. "The right wing has always had this s--- going, so I don't really worry about it," she said.
Where This Lands
Mace says Omar should lose her citizenship if the fraud is proven, and Loomer wants her deported. JD Vance has said, without evidence, that Omar committed fraud. Mullin says any case wouldn't be political. Joyce Vance says the search breaks a hard norm against overt steps right before an election. A source told CNBC the department sees no violation because the search wasn't meant to be public. Omar's side has called the fraud claims lies for years. She hasn't spoken about the search. The Justice Department hasn't said what it's looking for.
