1. Noncitizen Voting Is a Real Threat Before November (Trump, DHS Secretary Mullin, VP Vance, Rep. Ben Cline)

Supporters say 256,000 noncitizens are already on voter rolls and states have two weeks to do something about it.

One illegal vote cancels one legal vote, VP JD Vance said. "A single ballot cast illegally in an American election is in fact the theft of the ballot from another American citizen." Rep. Ben Cline (R-VA) added that the SAVE Act "ensures our elections are for Americans, by Americans."

China secretly acquired 220 million U.S. voter files, Trump claimed. The declassified documents include a DHS report citing approximately 278,000 noncitizens registered to vote. Trump said Russia and North Korea could also exploit election system vulnerabilities, and he announced he was releasing the intelligence to let the public judge for themselves.

256,000 potential noncitizens are on the rolls in four states, DHS says. The breakdown: roughly 190,832 in California, 35,152 in New Jersey, 15,903 in Nevada, and 14,576 in Pennsylvania. Secretary Mullin told states they have two weeks to run their rolls through the federal database or face consequences up to prison time for election officials who refuse. Sen. Mike Lee (R-UT) has tied the bill's passage directly to Republican prospects in November.

2. But the Numbers Are Unverified and the Bill Would Block Real Voters (Nevada SoS Francisco Aguilar, Pennsylvania SoS Al Schmidt, Brennan Center)

Election officials of both parties say the data is bad, 21 million eligible Americans would lose access to registration, and the database DHS wants states to use is already blocked in court.

256,000 is a preliminary number, not a confirmed count. DHS didn't disclose which databases it compared, what confidence standard it used, or how it screened out recently naturalized citizens. Nevada Secretary of State Francisco Aguilar called the figures "wildly speculative at best" and said DHS hadn't shared anything to back them up. Pennsylvania Secretary of State Al Schmidt, a Republican, said "all evidence has shown that noncitizen voting is extremely rare" and asked DHS to share its methodology before he could review their claims.

The SAVE Act would lock out over 21 million eligible Americans. The Brennan Center for Justice estimates that's how many citizens lack a passport, birth certificate, or naturalization certificate — the documents the bill requires. Driver's licenses and REAL IDs don't qualify. When Arizona and Kansas tried similar requirements, the rules shut out tens of thousands of eligible voters. Married women who changed their names often lack proof of citizenship in their current identity.

Courts already blocked the database Mullin wants states to use. Judge Sparkle Sooknanan (D.C.) blocked the Trump administration's overhaul of the DHS SAVE database on June 22, ruling it violated privacy laws. A Trump-appointed judge in Florida later ordered it restored for four states — directly contradicting the D.C. ruling and creating conflicting court orders. The court set a hearing for July 20 to sort out the conflict. Election officials of both parties told CNN they're worried the administration will use the voter roll data to cast doubt on the midterms if Republicans underperform.

3. Still, the Senate Won't Nuke the Filibuster to Pass It (Thune, Murkowski, Collins, McConnell)

Some Republicans say the Senate path is broken — and a few say the bill itself is too.

Republicans don't have the votes, not even close. Senate Majority Leader John Thune (R-SD) told Fox News: "The only way you can get this done is to nuke the legislative filibuster, and that is not something that we have anywhere close to the votes to do." Republicans hold 53 seats and would need 7 Democrats — none have crossed.

Four Republican senators already voted against the bill. Senators Lisa Murkowski (AK), Susan Collins (ME), Thom Tillis (NC), and Mitch McConnell (KY) voted against adding SAVE Act provisions to the budget reconciliation package in June. The Senate voted the bill down in June 2026.

The bill would strand Alaska's most isolated voters. Sen. Lisa Murkowski (R-AK) has been the most direct Republican critic. She says 20 percent of Alaska's population isn't on the road system, meaning some rural and Native Alaskan residents would need to buy plane tickets and book lodging just to register in person. She wrote: "I support voter ID — but oppose the SAVE America Act."

The administration has set a two-week deadline for states to use a database that a federal court has blocked, with a hearing to resolve conflicting court orders set for July 20. The Senate couldn't pass the SAVE Act in June and Thune says it still can't.
