The service launches August 1, and customers have already signed up. Trump's posts have moved markets before: on April 9, 2025, he posted "THIS IS A GREAT TIME TO BUY!!! DJT" on Truth Social shortly before announcing a 90-day tariff pause that sent the S&P 500 up nearly 10% — its largest single-day gain since 2008. The Trump family trust owns roughly 42% of Trump Media's shares.
1. This Is Normal Data Business (Kevin McGurn, Interim CEO of Trump Media)
Trump Media says it's just formalizing what firms were already doing — and charging for it.
Markets already react to his posts; the API just licenses that reality. Trump Media interim CEO Kevin McGurn said: "Markets already move on Truth Social posts. Truth API delivers a direct, licensed, real-time feed of the platform's most market-moving Truths while advancing our strategy to monetize proprietary assets through a high-margin, recurring revenue stream." The company argues that firms were already scraping Truth Social data illegally — McGurn told Reuters they'd be creating "a lot of friction for those folks that aren't coming to us directly."
A tech company can legally tier its data. Robert Frenchman, a partner at Dynamis LLP who has represented clients in federal trading investigations, told Reuters: "It certainly does not seem fair, but yes, a tech platform can tier its distribution of information without violating federal securities laws." Under current U.S. securities law, insider trading requires trading on material non-public information in breach of a legal duty — and the API delivers content that will quickly become public.
2. The President Is Selling His Policy Announcements for Profit (Sen. Richard Blumenthal, Virginia Canter, Kathleen Clark)
Critics say a data product is one thing — a president routing his official communications through a company he profits from is another.
The president is selling access to official communications he controls. Sen. Richard Blumenthal (D-CT) said: "The President's social media posts — covering war & peace & government regulations — move markets. Truth Social selling preferential access is yet another example of flagrant corruption, trading access to the White House for Trump's self-enrichment." Sen. Ron Wyden (D-OR), the ranking Democrat on the Senate Finance Committee, said the product would enrich the Trump family and "make Wall Street traders rich."
His financial stake is the core problem. Virginia Canter, an ethics attorney at Democracy Defenders Fund, put the conflict of interest directly: "The president has an obligation to the American people to convey information to them publicly, and he's now funneling it through a private channel in which he has a private interest as one of its largest shareholders." Trump family entities own roughly 42% of Trump Media.
It's not like Bloomberg. Kathleen Clark, a Washington University School of Law expert on government ethics, draws the distinction: "He's selling expedited, privileged access to information about what he is doing as president. It's yet more brazen corruption, an improper exploitation of government power to enrich himself."
3. Securities Lawyers Think It Might Be Criminal (Richard Painter, James Cox)
The legal debate turns on whether Trump's posts about government policy count as "government information" — that category carries much higher legal exposure.
This could trigger criminal charges and civil suits. Richard Painter, who served as chief White House ethics lawyer under President George W. Bush, was direct: "Selling access to United States government information to people trading in securities markets, I think, is an invitation to a criminal insider trading investigation and civil suits under the contemporary traders' provision. It's terrible." He draws a specific line: Trump's personal opinions about private companies may be permissible, but posts disclosing government business are a different matter.
Nobody has classified Trump's policy posts as government information — yet. Duke law professor James Cox frames the unresolved core: "Who's giving authority to release this information that is material and non-public?" Cox predicts "tremendous legal challenges" and notes the political pressure heading into midterms is severe. The SEC hasn't said publicly whether the Truth API triggers its oversight — and that silence is the open question.
Where This Lands
Trump Media says it's a data business, just like any other financial information provider. Ethics critics say a president selling faster access to his own policy communications — through a company where he holds a 42% stake — is corrupting the office directly. Securities lawyers say that if Trump's policy posts count as government information, this product isn't just distasteful — it's potentially criminal. The Truth API launches August 1.
